Terms of Service
The short version. Use HeyFig responsibly. Don't break the law or hurt other people. You own the content you create; we have a limited license to operate the service for you. Our products are in beta — they may change, break, or be unavailable. Don't rely on AI output for medical, legal, or financial decisions.
These Terms of Service ("Terms") form a binding agreement between you and HeyFig, Inc. ("HeyFig", "we", "us", "our") and govern your access to and use of heyfig.ai, Catalogue, and our other products and services (collectively, the "Services"). By using the Services, you agree to these Terms.
1. The Services
HeyFig provides AI-based personal organization tools. Our flagship product, Catalogue, is a conversational assistant that helps you keep your week, your habits, and your ideas in order. Some or all of the Services may be offered as a free or invitation-only beta. Beta features are provided "as is" and may be modified, suspended, or discontinued at any time.
2. Eligibility
You must be at least 16 years old (or the minimum age required by law in your jurisdiction) to use the Services. By using them, you represent that you meet this requirement and that you are not barred from using them under any applicable law. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Your account
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at security@heyfig.ai if you suspect unauthorized access. We may suspend or terminate accounts that we reasonably believe are being misused.
4. Acceptable use
You agree not to use the Services to:
- Violate any law or the rights of others, including intellectual property and privacy rights;
- Send spam, malware, or other harmful or deceptive content;
- Harass, threaten, or impersonate another person;
- Generate content that sexually exploits or endangers minors, promotes self-harm, or incites violence;
- Reverse engineer, scrape, or otherwise circumvent technical or rate limits, except to the extent expressly permitted by law;
- Use the Services to develop a competing AI model or product, including by extracting outputs to train another model.
5. Your content
"User Content" means anything you submit to the Services, including messages, lists, notes, and files. You retain all ownership rights you have in your User Content.
By submitting User Content, you grant HeyFig a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display that content solely for the purpose of operating, securing, and improving the Services for you. This license ends when you delete the content or your account, except for backups retained for a limited period as described in our Privacy Policy.
You are responsible for the User Content you submit and represent that you have the rights to submit it.
6. AI outputs
The Services use machine learning models to generate responses ("AI Outputs"). AI Outputs may be inaccurate, incomplete, or inappropriate, and may sometimes describe events or facts that are not real. You are responsible for evaluating any AI Output before relying on it. Do not use AI Outputs as a substitute for advice from a qualified medical, legal, financial, or other professional.
As between you and HeyFig, you own the AI Outputs generated for you by the Services, to the extent permitted by law and subject to others' rights in similar or identical outputs. We do not use your prompts or AI Outputs to train general-purpose AI models, as described in our Privacy Policy.
7. Fees and beta program
Catalogue is currently offered at no cost during private beta. We may introduce paid plans in the future and will give you reasonable notice before any fees apply to you. If we introduce paid plans, the applicable order form or in-product disclosure will describe the fees, billing terms, and refund policy.
8. Our intellectual property
The Services, including all software, designs, logos, and content we create, are owned by HeyFig and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.
9. Third-party services
The Services may interoperate with or rely on third-party services (for example, AI inference providers, cloud infrastructure, and email delivery). Your use of any third-party service is subject to that service's own terms, and we are not responsible for third-party content or practices.
10. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if your use creates risk or legal exposure for HeyFig, or if we discontinue the Services. Provisions that by their nature should survive termination (such as ownership, disclaimers, and limitations of liability) will survive.
11. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE OR RELIABLE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEYFIG AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
13. Indemnification
You agree to defend, indemnify, and hold HeyFig harmless from any claim, demand, or damages arising from (a) your User Content, (b) your use of the Services, or (c) your violation of these Terms or any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing in this section limits any non-waivable rights you may have under the laws of your country of residence.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or through the Services) before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
